1. Introduction & Agreement

By downloading, installing, or using the Zon mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Acknowledgement regarding Apple Inc.: You acknowledge that these Terms are concluded between you and Zon only, not with Apple Inc. ("Apple"). Zon, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

2. Description of Service

Zon is a fitness and social platform that allows users to:

Track workout sessions and exercises via AI-assisted logging
Share workout progress with the community
Join tribes and connect with other fitness enthusiasts
Participate in challenges and duels
Access Premium content via subscription

3. Medical Disclaimer & Safety

IMPORTANT: Zon is not a medical provider. You exercise at your own risk.

Not Medical Advice: The App, including its AI Coach, provides information for educational and entertainment purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
Consult a Doctor: Always consult with a qualified healthcare professional before beginning any exercise program.
Listen to Your Body: Stop exercising immediately if you experience pain, dizziness, or shortness of breath.
Assumption of Risk: You assume all risks associated with physical activity. Zon is not responsible for any injuries or health issues that may result from using the App.

4. AI Features Disclaimer

The App uses Artificial Intelligence (AI) to generate coaching advice and chat responses.

Accuracy: AI responses are generated automatically and may contain errors. Do not rely on them for critical health decisions.
No Human Oversight: Conversations with the AI Coach are not monitored by human coaches in real-time.

5. Subscriptions and Payments

Zon offers a "Premium" subscription that unlocks advanced features (e.g., unlimited access, advanced stats, exclusive programs).

Billing and Renewal

Payment: Payment will be charged to your iTunes Account at confirmation of purchase.
Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
Account Charges: Your account will be charged for renewal within 24-hours prior to the end of the current period at the original subscription price.

Cancellation and Refunds

Management: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store after purchase.
No Refunds: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription. Refunds are managed directly by Apple, not Zon.

6. User Accounts

Eligibility: You must be at least 13 years old to use the App.
Security: You are responsible for maintaining the security of your account credentials.
Responsibility: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

7. User Conduct & Content (EULA)

Zero Tolerance Policy

We have a zero tolerance policy for objectionable content and abusive users. We reserve the right to ban any user who posts:

Hate speech, discrimination, or harassment
Explicit sexual content or nudity
Violence or threats
Spam, scams, or illegal content

Reporting and Blocking

Users have the ability to block other users and report inappropriate content directly within the App. Reported content will be reviewed within 24 hours, and appropriate action (content removal, user ban) will be taken.

Your License to Us

By posting content (photos, text, workouts), you grant Zon a non-exclusive, royalty-free license to use, display, and distribute said content within the App and for marketing purposes.

8. Intellectual Property

The App, its design, code, "Zon" logo, and AI algorithms are the property of Zon. You may not copy, modify, or distribute our content without written permission.

9. Termination

By You: You can delete your account at any time in Settings > Danger Zone. This permanently deletes your data. By Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

11. Third-Party Beneficiary (Apple)

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of France. Any disputes will be resolved in the competent courts of France.
